Wind & Brass Instrument Rental Agreement
1. TERMS
I, the Renter, agree to rent this instrument. Payments are due in advance and will be automatically charged to the credit card provided at the inception of this agreement until this rental agreement is terminated as described below.
2. CREDIT CHECK
This rental agreement is not an extension of credit. However, Wind & Brass may perform a credit check to determine eligibility and/or during collection efforts. Delinquent accounts may appear on your credit record as a result of collection efforts.
3. SERVICE PLAN
The Service Plan included with this agreement provides for minor repairs and adjustments to the instrument, case latches, and handles.
The Service Plan does not include:
- Cleaning of instruments
- Cosmetic repairs or finish work
- Deliberate abuse, intentional damage, or negligence
Any major damage to the instrument or case will incur a charge of up to $250.00 (includes broken/missing parts, major dents or cracks).
The Service Plan is void if the rental payment is past due.
A police report is required for any claims of theft.

4. TERMINATION
The Renter agrees to return the instrument and included accessories in the same condition as received (less normal wear) by the end of any monthly rental period following the minimum rental period. All outstanding balances must be paid in full to terminate this agreement.
No refunds will be issued for early returns.
4(a). PAYOFF OPTION
This agreement includes a payoff option.
Upon completion of payments as outlined, ownership of the instrument transfers to the renter.
100% of the rental portion of all payments apply toward purchase, less 1.5% of the remaining balance each month.
Wind & Brass will notify the renter upon successful fulfillment of this agreement.
5. SECURITY
The Renter authorizes Wind & Brass to charge the credit card provided at rental initiation.
If that card becomes invalid or is declined:
- A new valid card must be provided, or
- The instrument must be returned immediately
Rental payments will continue to accrue until this agreement is properly terminated as outlined above.
6. VALUE
The instrument remains the property of Wind & Brass throughout the rental period.
If the account becomes delinquent or the instrument is not returned, the renter is responsible for the full replacement value.
Bankruptcy does not relieve you of responsibility to return the instrument or comply with this agreement.
7. AGE REQUIREMENT
You must be at least 25 years old to rent an instrument from Wind & Brass.
NOTICE
Failure to return rental property may result in legal action.
If the account becomes delinquent and the instrument is not returned, Wind & Brass will pursue legal remedies including but not limited to reporting to law enforcement under California theft statutes.

By signing this agreement, the Renter confirms they have read and understood all terms and conditions, and that the instrument has been inspected and received in good condition.
